Participant Coach Training Agreement

Welcome to Positive Coaching! We are delighted to have you in our program. We operate our business and programs with a commitment to the highest level of ethics and quality. Accordingly, we ask that you review this Participant Coach Training Agreement and indicate by your signature that you understand our policies and expectations and will comply with these standards and protocol in all aspects of your engagement with Positive Coaching. We thank you for your consideration and diligence.

ACCREDITATIONS: I understand that Positive Coaching Solutions is accredited by the International Coaching Federation (ICF) as a Level 1 and Level 2 coach training provider and by the Center for Credentialing and Education (CCE) as a Registered Coach Training Provider (RCTP) for the Board Certified Coach (BCC) credential. Accordingly, it will be following procedures, policies, guidelines, and requirements stipulated by each for granting program completion credit. As such, should I desire to become a certified coach by either of these organizations, I understand that it is MY responsibility a) to attend and fully participate in the program to receive a certificate of completion for the stipulated number of training hours; b) to obtain and document the relevant client coaching experience hours required for my desired certification level, which includes getting permission from my clients to include them in my documentation; c) if applicable, to document the relevant mentor coaching information required for my desired certification level (ICF only); d) to obtain permission from my clients to record live coaching sessions for purposes of my performance evaluation (ICF only); e) to obtain and submit my academic transcript(s) and professional endorsement (BCC only); f) to submit my application(s) to the ICF or CCE for certification in good faith; and g) to satisfactorily complete the examinations necessary to obtain my credentials.

SERVICES: I understand that Positive Coaching and its faculty are not licensed by or representing any medical or therapeutic model. I further understand that this program does not constitute any type of therapeutic intervention. I assume full responsibility for my participation and use of the training materials.

COPYRIGHT: Positive Coaching is engaged in the development and delivery of training which includes proprietary models, publications, web-delivered materials, and other copyrighted materials. All such models and materials offered in its classes are the sole properties of Positive Coaching, subject to existing copyrights for which Positive Coaching has permission to use. All rights are reserved.

I understand that as a condition of my enrollment and participation in this educational program, all copyrighted materials are not to be reproduced or used without written permission from Positive Coaching. Positive Coaching will pursue appropriate legal and professional action for infringements of any kind, including reporting associated ethics violation to the ICF or CCE.

COACHING PRACTICE: I understand that Positive Coaching’s programs include extensive practice coaching. Participants in the programs as well as “volunteer clients” will serve in the role of client during training sessions.

At any time that I am serving in the role of CLIENT, I understand and agree to the following: I am fully responsible for my physical, mental, and emotional well-being during my coaching session, including my choices, decisions, and actions. I am aware that I can choose to discontinue coaching at any time. I understand coaching does not involve the diagnosis or treatment of mental disorders nor is it a substitute for professional advice by legal, medical, financial, business, spiritual, or other qualified professionals. I understand that I am free to reject any advice, suggestions, or requests made by my coach at any time. I understand that I am engaging in faculty supervised coaching by another Positive Coaching student. I understand that certain topics may be shared with other students and faculty for training and consultation purposes. I release Positive Coaching and its students and faculty from any liability for my coaching sessions. I commit to being authentic and real in offering legitimate topics to be coached on—I will not create a hypothetical or imaginary issue to present to my coach. I understand that would be unprofessional and unfair to my coach for learning purposes.

At any time that I am serving in the role of COACH, I understand and agree to the following: I am responsible for providing coaching according to the ethical guidelines and best practices of the coaching professional as delineated in the ICF Code of Ethics and Coaching Competencies which will be included in your class materials and is available at https://coachingfederation.org/. I also understand that my client, whether classmate or “volunteer”, has signed an agreement for coaching with the same conditions stated above. I will honor those conditions in all my interactions with Clients. I commit to doing my very best to practice the skills presented in the class and to avoid taking on the personal responsibility for “fixing” my client’s issue.

CLASSROOM CONDUCT: All students are required to behave in a professional, ethical, and respectful manner throughout all of Positive Coaching’s events and within any classroom or subsequent communication among Positive Coaching students and faculty. I understand and agree that if I violate this standard of professionalism and respectful behavior, I may be discharged from the program, will forfeit all fees paid, and Positive Coaching may take appropriate measures regarding my application(s) for coach certification.

NON-DISCRIMINATION POLICY: I understand that Positive Coaching welcomes students of any race, color, sexual orientation, gender expression, age, religion, disability, national or ethnic origin and does not discriminate in the administration of or admission to its educational programs. Any student behavior that disrespects such diversity will not be tolerated and will incur the penalties described in the paragraph above.

HARASSMENT POLICY: Positive Coaching is committed to maintaining a training environment that is free of harassment. Harassment is defined as any behavior that is unwelcome, unwanted, and creates an uncomfortable or hostile environment. This behavior can be in the form of sexual advances and/or requests, jokes, comments, offensive remarks, offensive pictures. Harassment can also be verbal abuse or bullying.

These behaviors are completely unacceptable and will not be tolerated. If any harassing behavior is observed or experienced, I will notify an appropriate Positive Coaching faculty or staff member. Positive Coaching will thoroughly and promptly investigate any and all claims of harassing behavior and commits to protecting your privacy as much as possible in the course of the investigation.

Verified claims of harassment will result in immediate action. Confirmed harassing behavior by a student will result in the penalties described in CLASSROOM CONDUCT above. Confirmed harassing behavior by an employee, instructor, mentor coach, or consultant will result in immediate disciplinary action, up to and including termination of the individual’s employment, contract, or other services, as applicable. The verification process is at the sole discretion of Positive Coaching.

RELEASE OF LIABILITY: Participation in Positive Coaching is at the students’ risk. I understand and agree to waive and release any and all claims against Positive Coaching Solutions, its agents, faculty, or employees of personal injury or loss of or damage to property damage arising from participation in Positive Coaching’s programs. I also understand and agree that either virtual or in-person classes may be recorded.

I give Positive Coaching permission to share these recordings, in part or in full, with members of my cohort and faculty. For any segment that includes my identifiable participation, Positive Coaching must seek my explicit approval to share with anyone outside this agreed upon group.

STUDENT COMPLAINTS: Any complaints regarding the program, faculty, students, or other concerns should be promptly submitted to Mina Brown, mina@positivecoach.com. Positive Coaching will make every reasonable effort to resolve student concerns in a timely and appropriate manner. Disputes arising from unresolved complaints will be submitted first to mediation, then if necessary, binding arbitration. The jurisdiction for all disputes will be Dallas, Collin County, Texas. Dispute resolutions are limited to fees paid.

ILLNESS/ABSENTEE POLICY: Positive Coaching understands that occasional emergencies or unexpected events will occur. As such, the following Illness or Absentee Policy is intended to acknowledge those events and provide the best learning experience for everyone involved. If a student misses up to 7.5 hours, Positive Coaching faculty will help them make the time up using recorded sessions, reading assignments, and documentation activities that will be validated by a faculty member through interviews, discussions, role plays, or other appropriate methods. Any student missing 7.5 hours or more may be removed from the cohort (based on faculty discretion). Any student who is a “no show, no contact” will immediately forfeit any payment received and will not be considered for transfer of credit or substitution options.

ENROLLMENT, PAYMENT, CANCELLATION, AND TRANSFER POLICY: Candidates must complete an Application upon registration. Positive Coaching reserves the right to accept or reject students at its sole discretion. A non-refundable $995 deposit is required at registration to reserve a seat in the class. All tuition must be paid in full 30 days prior to the program or a properly executed installment agreement must be in place and the first installment must be paid.

Deposits are non-refundable but can be transferred along with any tuition paid to another acceptable participant or applied to a future program without penalty up to 30 days before the class. Within 30 days prior to the class, all fees paid are non-refundable but may be transferred to a future class or another participant acceptable to Positive Coaching with a $1,000 transfer fee. The option to transfer to a future class expires 18 months after the start date of the current class and is subject to available capacity and the prevailing tuition rate in the desired program. The transferring or substitute participant must pay any tuition differential before the transfer can be confirmed. This cancellation policy also applies to all tuition paid or payable according to an Installment Agreement.

INSTALLMENT PLANS: Installment plans are available for students at Positive Coaching’s sole discretion. A non-refundable $995 deposit is required at registration to reserve a seat in the class. The balance of the tuition can be spread out up to six months. A $10 administrative fee is charged for each payment. The first installment payment (after the deposit) must be made before the first day of class. An Installment Agreement must be completed, signed and returned to Positive Coaching to secure the payment arrangement. Any default on an installment plan is subject to penalties and reimbursement of collection fees as well as revocation of the Certificate of Completion and discontinuation of any remaining mentor coaching, as applicable.
